Each piece of artwork is authentically crafted by WL Eaton, ensuring genuine and unique creations.

Every painting is shipped with a certificate of authenticity, which includes important details such as the Artwork Title, ID number, Year Created, and the Artist's Signature.

All artwork will be shipped within 3 - 5 working days, via DHL, ensuring reliable delivery to your location. Each shipment includes a tracking number so you can monitor your package every step of the way.

Artwork will be carefully removed from its canvas frame, rolled up, and securely placed in a protective tube.

The tube measures 1.3 meters in length and 15 centimeters in diameter, with an approximate weight of 3.5 kilograms, ensuring safe and convenient transportation.

Welcome to WL EATON ART (“we,” “us,” “our”), an online platform dedicated to the sale of original, authentic artwork created and crafted in South Africa by the artist WL Eaton. By accessing or using the WL EATON ART website (the "Site"), you agree to comply with and be bound by these Terms and Conditions ("Agreement" or "Terms"). Please read this Agreement carefully before using our services. If you do not agree with any part of these Terms, you must refrain from using the Site.

1. DEFINITIONS

• "Customer," "User," "You," and "Your" refer to the person or entity accessing or purchasing products from the Site.

• "Artwork" refers to the authentic art pieces offered for sale on the Site, including paintings, prints, and other forms of art.

• "Order" refers to a request placed by a customer for the purchase of Artwork through the Site.

2. ACCEPTANCE OF TERMS By accessing, browsing, or using the Site, you acknowledge that you have read, understood, and agree to be bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms, you must immediately discontinue use of the Site.

3. ELIGIBILITY To purchase Artwork from the Site, you must:

• Be at least 18 years old or the legal age of majority in your jurisdiction.

• Have the legal capacity to form a binding contract.

• Provide accurate, current, and complete information as required during the registration or checkout process.

4. PRODUCTS AND AVAILABILITY

• All Artwork listed on the Site is subject to availability. We make every effort to ensure that the information on the Site, including descriptions, pricing, and availability, is accurate; however, we cannot guarantee the accuracy or completeness of this information.

• In the event that a product is unavailable or an error is discovered after you have placed an Order, we will notify you and provide options for resolving the issue.

5. ORDER PROCESS

• To make a purchase, you must add Artwork to your cart and proceed through the checkout process.

• By placing an Order, you offer to purchase the Artwork under the terms of this Agreement.

• After placing an Order, you will receive an Order confirmation email. This email does not constitute acceptance of your Order but is a confirmation that we have received your request. An Order will only be considered accepted when we process and ship the Artwork.

6. PAYMENT

• Payments for purchases must be made via the payment methods accepted by WL EATON ART, including but not limited to credit cards, debit cards, or online payment processors (e.g., PayPal).

• The total cost of your Order will include the price of the Artwork, applicable taxes, and any other charges.

• All payments are processed through secure payment gateways, and your financial information is protected according to industry standards.

7. SHIPPING AND DELIVERY

• We offer international shipping, delivery timeframes vary depending on your location.

• WL EATON ART is not responsible for customs duties, taxes, or other fees that may be imposed by the destination country. You are responsible for any additional charges associated with international shipping.

• Delivery times are estimates and are not guaranteed. Delays may occur due to factors beyond our control.

8. RETURNS AND REFUNDS

• Returns: Due to the unique and one-of-a-kind nature of the Artwork, we do not accept returns unless the item arrives damaged or defective.

• Damaged or Defective Artwork: If you receive an item that is damaged or defective, please contact us within 10 days of receipt with clear photographic evidence, and we will work to resolve the issue, either by offering a replacement or a refund, as appropriate.

• Refunds: Once we approve a return or refund request, we will process the refund to your original payment method. Please allow 10 business days for processing.

9. INTELLECTUAL PROPERTY

• All content on the Site, including but not limited to text, graphics, logos, images, and artwork, is the property of WL EATON ART and is protected by copyright, trademark, and other intellectual property laws.

• You may not copy, reproduce, distribute, or otherwise use any of the content on the Site without prior written consent from WL EATON ART.

10. USER CONDUCT By using the Site, you agree to:

• Not engage in any activity that violates any applicable law or regulation.

• Not interfere with or disrupt the operation of the Site or its services.

• Not use the Site to post or transmit any unlawful, defamatory, obscene, or otherwise objectionable material.

• Not impersonate any person or entity or misrepresent your affiliation with any entity.

11. LIMITATION OF LIABILITY

• WL EATON ART makes no warranties or representations, express or implied, regarding the accuracy, quality, or reliability of the Artwork or the Site.

• We shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Site, the Artwork, or these Terms, including but not limited to any loss of profit or data.

• In no event shall our total liability exceed the amount you paid for the Artwork that gave rise to the claim.

12. INDEMNIFICATION You agree to indemnify, defend, and hold harmless WL EATON ART, its officers, directors, employees, agents, and affiliates from any and all claims, damages, liabilities, costs, and expenses (including reasonable legal fees) arising from your violation of these Terms, your use of the Site, or your purchase of Artwork.

13. PRIVACY POLICY By using the Site, you consent to the collection and use of your information as outlined in our Privacy Policy.

14. CHANGES TO TERMS WL EATON ART reserves the right to modify, update, or change these Terms at any time, at our sole discretion. Any changes will be posted on this page with an updated "Effective Date." You are encouraged to review these Terms periodically for any changes. Your continued use of the Site following the posting of changes constitutes your acceptance of those changes.

15. GOVERNING LAW AND DISPUTE RESOLUTION

• These Terms shall be governed by and construed in accordance with the laws of South Africa.

• Any disputes arising out of or in connection with these Terms or your use of the Site shall be resolved through binding arbitration, in accordance with the rules of the courts of South Africa.

16. FORCE MAJEURE WL EATON ART will not be held liable for any delays or failure to perform its obligations under this Agreement due to circumstances beyond our reasonable control, including but not limited to natural disasters, strikes, pandemics, or other unforeseen events.

17. SEVERABILITY If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full effect.

18. ENTIRE AGREEMENT These Terms, together with the Privacy Policy and any other legal notices published on the Site, constitute the entire agreement between you and WL EATON ART regarding your use of the Site and the purchase of Artwork.
